
These Terms describe subscriptions, uploads, public discovery, billing through Paystack, acceptable use, and how Impuls Media Group operates the platform.

These Terms of Use (“Terms”) govern access to and use of PulsCast, including the website, authenticated operator dashboard, media upload and library tools, playlists, scheduling, automated playout, break rules, analytics, optional AI-assisted station tools (where enabled), public station pages, the public 3D discovery globe, embeddable or linked watch experiences, and any related documentation or support interfaces.
PulsCast is made available by Impuls Media Group (“we”, “us”, or “our”). Except for your content and third-party materials you choose to integrate, the software, services, interfaces, look-and-feel, branding, and underlying technology remain the exclusive property of Impuls Media Group and its licensors, and all rights not expressly granted are reserved.
Formal legal or copyright notices relating to the service may be directed through the contact methods described in Section 13.
You must be legally able to form a binding contract in your jurisdiction. You may not create an account if you are barred from receiving the service under applicable law.
You are responsible for providing accurate profile information, safeguarding passwords, securing devices that access the dashboard, and for all activity that occurs under your credentials.
The service is not directed to children under 13. Users between 13 and 18 should use PulsCast only with the consent of a parent, guardian, or authorized organization.
Certain features require an active subscription or trial as presented in-product. Fees, entitlements, and usage limits depend on the plan, currency, interval, and add-ons you select.
Payments are processed by Paystack or other payment processors we name at checkout. Card data is handled according PCI standards by the processor; we receive limited billing metadata (for example subscription status, customer identifiers, and invoice references).
Unless otherwise stated, fees are billed in advance for each billing cycle, are non-refundable except where required by law, and exclude taxes, levies, or duties which you remain responsible for where applicable.
Upgrades, downgrades, add-ons, payment-method changes, or cancellations may be managed through the in-app Billing settings and the Paystack Customer Billing Portal linked from that experience. Proration and timing follow Paystack’s defaults unless we notify you otherwise in writing.
If payment fails or an account is past due, we may pause automated outputs, restrict uploads, or suspend access until balances are resolved, in addition to any rights Paystack exercises under its own terms.
You retain ownership of videos, audio, images, schedules, metadata, branding assets, and other materials you upload or submit (“Your Content”).
You grant Impuls Media Group a worldwide, non-exclusive, royalty-free licence to host, reproduce, transcode, adapt for streaming or download delivery, transmit, display, and otherwise use Your Content solely to operate, secure, improve, troubleshoot, and promote PulsCast during the term of your use and for a reasonable wind-down period afterwards.
You represent and warrant that you possess all necessary rights, licences, and consents for Your Content, including performance, synchronization, trademark, publicity, and neighbouring rights for every territory where you make the channel available.
You are solely responsible for music reporting, royalty payments, broadcaster registrations, age ratings, emergency-alert obligations, sponsorship disclosures, and any other regulatory duties that apply to your transmissions.
You may not use PulsCast to violate law, harass others, distribute malware, attempt unauthorized access, interfere with service integrity, generate fraudulent metrics, impersonate third parties, mislabel sponsorships, or stream content you are not authorized to distribute.
You may not scrape non-public APIs, overload infrastructure, or exploit automation to evade enforcement. We may throttle, queue, or block traffic that appears abusive.
We may suspend content, stations, or accounts where we reasonably believe there is legal, security, or rights-holder risk, pending investigation.
Stations that opt into or default to public visibility may appear on listener experiences such as the globe, station cards, shareable URLs, and embedded players. Those surfaces can expose station names, descriptions, logos, genres, geography, live/idle status, and other promotional fields you configure.
You are responsible for ensuring publicly visible fields contain only information you are comfortable sharing. Features labeled as “private”, “ImPass”, or similar may add additional access controls; misconfiguration remains your responsibility.
The PulsCast name, logos, documentation, dashboards, visual design, and codebase(s) are protected by copyright, trademark, and other laws. No Terms language transfers ownership of the platform to you.
You receive a limited, revocable, non-transferable licence to access the service through interfaces we provide, subject to these Terms and your plan entitlements.
PulsCast relies on infrastructure, storage, video processing, email, analytics, fraud prevention, maps/globe rendering, and payment providers. Your use of those components may be subject to additional third-party terms.
We may introduce or replace subprocessors where reasonably necessary to maintain security, compliance, or performance.
We strive for reliable uptime but do not guarantee uninterrupted or error-free operation. Maintenance, vendor issues, internet conditions, or security incidents may cause outages.
We may modify, deprecate, or add features. For material changes that reduce core functionality for paying customers, we will use reasonable efforts to provide notice via email or in-app messaging when practicable.
You should retain independent backups of critical media, playlists, schedules, and configuration exports where the product allows.
You may stop using PulsCast at any time. We may suspend or terminate access for breach, risk, non-payment, or unlawful activity, with or without notice where permitted by law.
Upon termination, we may delete or retain data per our Privacy Policy, legal obligations, and backup cycles. Some obligations (for example indemnities, limitation sections, and dispute provisions) survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSCAST IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Impuls Media Group WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, AUDIENCE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Impuls Media Group’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO Impuls Media Group FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ZAR 1,000 IF NO FEES WERE PAID DURING THAT PERIOD.
You agree to indemnify and hold harmless Impuls Media Group, its affiliates, personnel, and suppliers from any third-party claims, losses, or expenses (including reasonable attorneys’ fees) arising from Your Content, your distribution thereof, your violation of these Terms, or your violation of applicable law.
These Terms are governed by the laws of South Africa, without regard to conflict-of-law rules that would require another jurisdiction’s laws. Courts located in South Africa have exclusive jurisdiction, subject to mandatory consumer protections in your place of residence.
We may update these Terms by posting a revised version and updating the “Last updated” date. Continued use after the effective date constitutes acceptance unless otherwise required by law.
